General terms and conditions of rental

In order to ensure that your journey runs smoothly, we invite you to read the following information on the rental of a Vehicle (hereinafter the "Vehicle(s)") and the optional insurance and additional protection available to you, the "Renter".
In entrusting you with a Vehicle, Run A Van undertakes to you and you undertake in return to be bound by the general and specific contractual conditions and the Tariff Conditions set out below (hereinafter the "Rental Conditions" or "TCC"), which you acknowledge having read before signing the Rental Agreement. By signing the Rental Agreement, you accept them without reservation.
The rental contract may not be less than 3 days - 2 nights.
In the event of non-compliance with the General Terms and Conditions of hire, the insurance policies are inapplicable. In this case, you are responsible for all damage attributable to you (including damage to the Vehicle up to the current value of the Vehicle plus the costs and expenses associated with its immobilisation).
CONDITIONS TO BE MET TO RENT A VEHICLE
With the exceptions set out below, all drivers must be at least 23 years of age and have held a valid driving licence for the category of Vehicle required for at least 3 years.
A driving licence issued by a Member State of the European Economic Area (EU Member States, and Iceland, Liechtenstein and Norway) is valid in France.
Holders of a permit issued by a state outside the European Economic Area must present a permit with a photograph, and written in French or accompanied by an official translation.
An international driving licence must be accompanied by a national licence.
If you hold a "white" or restricted licence, or if your driving licence has been reported lost or stolen, you are not entitled to hire a Vehicle.
The Hirer certifies on his or her honour that his or her driving licence is valid, and in particular that he or she is not subject to any measure of suspension, restriction or cancellation of the driving licence.
PREPAID BOOKING RUN A VAN
Run A Van agrees to reserve a Vehicle for the Hirer in advance subject to the payment of a deposit of 20% of the total rental amount requested.
This deposit will be cashed upon receipt. It will then be deducted from the total amount you will have to pay on the day of departure of the vehicle.
Regardless of the payments already made, Run A Van reserves the right to carry out any necessary checks and to agree or not to agree to the rental in the event of a legitimate reason. In the event of a deliberate reason, Run A Van reserves the right to return or not return any advance payments made.
In the event of a change to the booking (dates, vehicle category) due to the Hirer, Run A Van will invoice the Hirer €20 (incl. VAT) for contract amendment costs.
Cancellation at the tenant's initiative
Any request for cancellation on the part of the hirer must be sent to Run A Van by email or telephone at least 21 days before the effective date of commencement of the rental period. Otherwise, any deposits received will not be refunded in any form.
Cancellation at the initiative of Run A Van
Run A Van reserves the right to cancel, without compensation, any reservation if events beyond its control and/or force majeure oblige it to do so, such as (non-exhaustive list): decisions by the legal authorities, strikes, fire, natural disasters (water damage, impossibility of access, climatic events (cyclones, tropical storms, etc.)), vehicles that have been involved in accidents or have broken down, etc.
PAYMENT TERMS
The deposit can be paid by credit card, bank transfer, cash or bank cheque.
Upon collection of the Vehicle, the Hirer must pay Run A Van the full amount of the rental period, after deduction of any deposit received. Failure to do so may result in the rental of the Vehicle being refused.
You must also make a bank pre-authorisation by credit card or leave a cheque payable to Run A Van for a deposit of €2,500 including tax (two thousand five hundred euros including tax). The cheque or card must be made out to the principal driver.
The means of payment accepted to pay for your rental are bank cards, credit cards (Carte Bleue, Visa, Euro-Mastercard, Visa Electron, Visa +, Mastercard Maestro etc.), bank cheques from French establishments, cash (euros only) and Chèques-Vacances ANCV (limited to 300€ per rental contract).
The bank or credit card used to pay for the rental must be that of the main driver or, if applicable, that of the secondary driver, and must correspond to the bank or credit/debit card presented at the start of the rental.
NB: Run A Van does not accept American Express or Diners, Corporate-Business credit cards or debit cards, Indigo, Kyriel, Cyrus, and cash cards.
All payments made to Run A Van must be in Euros.
AT THE START OF THE RENTAL PERIOD
All vehicle departures are by appointment only, as Run A Van does not hold public meetings at its depot.
Vehicle departures can be made between 9am and 12pm Monday to Friday. Saturday departures are only possible for rentals of more than 5 days and are subject to availability of Run A Van staff. Any other appointment requested outside these times must be expressly accepted by Run A Van in advance. The Hirer must notify Run A Van as soon as possible, either by e-mail or by telephone, of any change in departure time. In the event of a delay not notified, you will have to agree on a new appointment depending on Run A Van's availability.
In the event of the Hirer's failure to show up on the day of departure, for whatever reason, and without prior notice to Run A Van, Run A Van may demand payment of the full rental price from the Hirer.
Before signing your Rental Agreement, please take the time to read the Rental Agreement.
When you pick up the vehicle, Run A Van staff will give you a specific presentation of the Vehicle you have hired, as well as its operation. This presentation includes an inventory of the Vehicle's equipment, whether or not it is separable and whether or not it is optional. You will have to carry out certain technical operations yourself, in front of the Run A Van staff, in order to use the vehicle properly.
A brief oral reminder of these T&Cs will also be given to the Tenant.
LEASE HOLDER
The name of the Hirer indicated on the Rental Contract is that of the main driver, who must be present at the time of signing the Rental Contract and to whom the costs associated with the rental are invoiced. In certain cases (gift vouchers, special requests) accepted by Run A Van, the rental price (excluding the security deposit and additional costs) may be invoiced in the name of the second driver or in the name of a third party.
Except for legitimate and unforeseeable reasons, only the driver(s) indicated on the Rental Contract is/are authorised to drive the Vehicle.
Additional drivers can be added for a supplement of €8 per day per additional driver.
In the event of damage to the Vehicle caused by a driver not named in the Rental Agreement, insurance is not applicable and you must compensate Run A Van for all damage attributable to you (including damage to the Vehicle up to the market value of the Vehicle plus the costs and expenses associated with its immobilisation).
DOCUMENTS TO BE PRODUCED ON COLLECTION OF THE VEHICLE
The driver must present an identity document (identity card or passport), the original driving licence, a bank, credit or debit card as a guarantee, and in the case of a Run A Van pre-paid reservation, a means of payment accepted by Run A Van (see above) to the Run A Van departure office.
Any additional driver must also present an identity document (identity card or passport) and the original driving licence when leaving the vehicle.
INSURANCE
All vehicles in the Run A Van fleet are covered against bodily injury and property damage caused to third parties.
The excess for this insurance is €1236 (one thousand two hundred and thirty six euros).
All vehicles in the Run A Van fleet are covered by comprehensive insurance.
The excess for this insurance is €1236 (one thousand two hundred and thirty six euros).
All vehicles in the Run A Van fleet are covered against fire and theft.
The excess for this insurance is €1236 (one thousand two hundred and thirty six euros) for theft and €1236 (one thousand two hundred and thirty six euros) for fire.
All vehicles in the Run A Van fleet are covered in terms of driver's insurance with no excess.
All vehicles in the Run A Van fleet are covered against glass breakage.
The excess for this insurance is €150 (one hundred and fifty euros).
GUARANTEE DEPOSIT
A security deposit of €2,500 (including VAT) must be deposited with Run A Van on the day of collection of the vehicle. In the event of refusal of the pre-authorisation of a bank card or the absence of a deposit, Run A Van reserves the right to refuse the Hirer the Vehicle.
The security deposit is intended to cover the following costs :
- the excess for all-accident insurance in the amount of €1236 including VAT (one thousand two hundred and thirty six euros including VAT);
- damage to the Vehicle or to a third party under the conditions stipulated below;
- the costs and expenses related to towing, immobilisation and repair of the Vehicle under the conditions stipulated below;
- the fixed allowance (€50) for the cost of administrative processing borne by Run A Van
- the financial responsibility for which the Hirer may be liable in the event of failure to comply with the CGL, and therefore not covered by the insurance contract. That is to say, all costs and expenses up to the market value of the Vehicle plus the costs and expenses associated with its immobilisation. In the event that the sums to be paid by you are greater than the security deposit, the Hirer shall remain liable for the full amount of the security deposit until it is paid in full.
This deposit will be returned or destroyed 72 hours after the time the vehicle is returned to the Run A Van branch (time of the SMS in the case of unmanned returns).
In the event of damage to the Vehicle or in the event of a dispute with the Renter, Run A Van reserves the right to retain any security deposit deposited under the Rental Contract for up to 90 days.
The Renter agrees that Run A Van may calculate and debit the final charges to his/her credit and/or debit card, if this is the form of deposit used, as set out in the Rental Agreement. Run A Van shall inform the Renter before charging the credit and/or debit card for any charges determined or appearing at the end or after the end of the contract.
In the event of a deposit by cheque, Run A Van may be able to cash this cheque and offer to refund the difference with the amount due, either by cheque or by bank transfer.
THE RENTAL RATE
The basic rate is composed of a fixed price proportional to the duration of the rental, without kilometre limit (except for minimum rentals (3 days and 2 nights) which offer a fixed kilometre limit of 270km) calculated according to the rates in force.
It includes:
- Third party liability insurance (third party) for bodily injury and material damage, with an excess of €1236 including tax in the event of a responsible accident,
- fire/theft insurance with an excess of €1236,
- glass breakage insurance with an excess of €150,
- All-accident insurance with an excess of €1236,
- telephone assistance in the event of a breakdown (during normal use), accident or fire (breakdown service or towing of the Vehicle if it is immobilised).
In the event of the Vehicle being immobilised due to circumstances beyond the driver's control, Run A Van may, subject to the availability of a vehicle, offer a replacement vehicle. In the event that a replacement vehicle is available, Run A Van will have the Hirer complete and sign an amendment to the rental contract naming the replacement vehicle.
The price does not include :
- fuel
- the options chosen by the tenant
- any excess mileage (3-day rental)
- damage not covered by the insurance (pop-up roofs and their equipment, mirrors, headlights, stickers, sun protection films, options, bodywork components, etc.)
- the cost of an expert's report in the event of a dispute
- any fines for which the driver of the Vehicle may be liable,
- the cost of repairs not covered by the insurance policies taken out and whose amount would exceed the amount of the excess in the event of an at-fault incident.
- rental of fitted sheets, pillows and pillowcases (6€/sheet, 2€/pillow and 2€/sheath).
SUPPLEMENTS
The rental rate may be increased by the supplements and optional services listed below.
Anything not expressly included in the rental price will be invoiced separately. The following list is not exhaustive:
- repair of damage to the Vehicle,
- the costs and expenses associated with the immobilisation and restoration of the Vehicle,
- loss or theft of the Vehicle and/or keys.
- overruns (0.45€ TTC / additional km).
- the interior (80€) and exterior (15€) cleaning of the vehicle
The rental rate is calculated on a flat rate basis, with each day started being a day due. The Vehicle is made available to the Customer by appointment between 9.00am and 12.00pm on the first day of hire and the Vehicle must be returned, blind, between 9.00am and 6.00pm on the last day of hire.
In the event of late payment, Run A Van will charge the Hirer a fixed fee (€40 including VAT) for collection costs, in addition to late payment penalties of 3 x the legal interest rate.
Loss / destruction of keys or keys locked in the van
In the event of loss or destruction of the keys or if the keys have been locked in the van, the hirer must inform Run A Van by SMS.
During the opening hours of the agency (9am-12pm), the tenant must go to the agency by his own means to collect a spare key at no extra charge. He must then return the spare key to the agency the same day.
During the hours between 12:00 and 18:00, the number of a professional locksmith will be provided in the vehicle and will be the contact person. The locksmith's service is at the expense of the Hirer.
-During the night hours (6pm-9am), a breakdown number will be available in the vehicle and will be the only contact person during this time. The Hirer must contact this breakdown service who will bring a replacement van to the Hirer's location.
The service of the breakdown mechanic will be charged to the Hirer plus the price of one day's rental of the replacement van. The Hirer must then go to the agency as soon as it opens in order to collect the spare key and return the replacement van before 6pm, respecting the return procedure.
Cleaning the interior and exterior of the Vehicle
If the exterior cleaning of the Vehicle is not carried out on return or if a thorough interior cleaning of the Vehicle is required on return, Run A Van will invoice the Hirer the lump sum(s) of €80 for an interior cleaning and €15 for an exterior cleaning.
OPTIONAL SERVICES
Run A Van offers the Hirer certain services in return for payment, including those listed on the www.runavan.re website.
Equipment for passenger vehicles
Run A Van also offers optional equipment, subject to availability and payment of a fixed amount per rental. The list of these facilities can be consulted on the website www.runavan.re.
The Hirer is advised to indicate to Run A Van, at the time of booking the Vehicle, the equipment that he/she wishes to have at his/her disposal as part of the rental. However, equipment changes may be made on the day of departure depending on availability.
Fitted sheets and pillows are paying options that are automatically included in the rental price. The tenant has the possibility, if he has his own fitted sheets, to remove this option on specific request.
ADDITIONAL DRIVER(S)
Except for legitimate and unforeseeable reasons, only the driver(s) indicated on the Rental Contract is/are authorised to drive the Vehicle.
Only for rentals of 5 consecutive days or more, the Hirer may add additional drivers, subject to a surcharge of €8 per day (with a maximum of 7 days charged) per additional driver.
The additional driver(s) must be indicated on the Rental Agreement at the time of departure of the Vehicle.
CONDITION OF THE VEHICLE
The Hire Agreement states the number of kilometres travelled by the Vehicle and the level of fuel supplied at the start of the hire.
The Hirer must check the apparent condition of the Vehicle, both inside and out, with a member of Run A Van's staff. This inventory of fixtures on departure shall be carried out by video with a verbal mention of the defects observed. The Hirer must make any additional observations necessary to establish an inventory of fixtures which will then be deemed exhaustive.
Until 24 hours after departure at the latest, if the Hirer notices any anomaly that was not indicated when the Vehicle left, he/she must provide proof of the anomaly noted (e.g. dated photograph or video) and contact Run A Van staff as soon as possible. Failing this, Run A Van will not be able to take into account any claims concerning damage supposedly existing at the time of the Vehicle's departure, other than that mentioned in the inventory of fixtures on departure, and the Renter will be presumed to be responsible for this damage.
The Hirer must compare the number of kilometres and the fuel level recorded on the dashboard with the information on the Rental Contract. The Hirer must have the Rental Contract rectified by Run A Van staff in the event of any discrepancy.
The Hirer shall ensure that a copy of the Vehicle registration document, the green insurance card and the accident report are in the Vehicle.
Run A Van provides the Hirer, free of charge, with a safety kit (triangle + waistcoat(s) + fire extinguisher) and a first aid kit in each Vehicle. The Hirer shall check that the high visibility waistcoat(s) is (are) placed in the passenger compartment, that a warning triangle is placed in the boot or under the rear seat and that the unused fire extinguisher is present in the Vehicle. If this is not the case, the Hirer must ask Run A Van staff to provide the missing items.
If one or more items of the first aid kit are used, the Hirer must inform Run A Van upon return of the vehicle unless the item(s) have been replaced identically.
DURING THE RENTAL PERIOD
The Hirer has legal custody of the Vehicle from the time of delivery and is therefore responsible for it until the keys are returned.
Run A Van cannot be held responsible for any failure to present the obligatory photocopied documents which are handed over at the start of the rental period.
The Hirer undertakes to take care of the Vehicle and to use it in a reasonable, normal and prudent manner.
In particular, the following are considered abnormal uses of the Vehicle (list not exhaustive)
– l’utilisation du Véhicule non conforme à sa destination (erreur de carburant, erreur de cuve de remplissage (eau<=>carburant) même si c’est le fait d’un tiers qui aurait dû être averti des spécificités du véhicule, casse de l’embrayage suite à mauvaise utilisation, mauvaise appréciation du gabarit du Véhicule, circulation en dépit des alertes apparaissant sur le tableau de bord du Véhicule, modification apportée au Véhicule, déplacement du véhicule avec le toit levé, etc…),
- traffic off the road,
- the crossing of submerged inverts,
- the use of the Vehicle to provide a passenger transport service (e.g. taxi) or goods transport service (e.g. removals or deliveries for a fee) for a fee,
- the transport of flammable, explosive, corrosive or oxidising substances,
- the use of the Vehicle for learning to drive,
- the use of the Vehicle in motor sport events, races or competitions (or trials thereof) or reconnaissance of rally routes,
- driving the Vehicle under the influence of spirits, narcotics, drugs or narcotics not prescribed by a doctor,
- the subletting of the Vehicle to a third party,
- Excessive use of the engine and/or auxiliary battery in spite of departure instructions or vehicle indicators,
- deliberate damage to the vehicle.
In the event of breakdowns, accidents or damage caused by one or more abnormal uses of the Vehicle, insurance is not applicable. In this case, you are responsible for all damage attributable to you (including damage to the Vehicle up to the market value of the Vehicle plus the costs of immobilisation).
Run A Van informs the Hirer that for reasons of hygiene, it is strictly forbidden to transport animals (of any species) in all Run A Van vehicles. Any offender will be liable to pay a specific cleaning fee of €80 (including tax) (which may be increased depending on the case).
Run A Van also informs the Hirer that all its Vehicles are non-smoking and that any offender will be subject to a fixed fee of €80 (inclusive of tax) for specific cleaning.
SECURITY
The Hirer undertakes to comply with the safety conditions laid down by the regulations, in particular the maximum capacity specific to each Vehicle in terms of the number of occupants and/or the weight of luggage or goods transported.
During the rental period and depending on the number of kilometres travelled, the Hirer undertakes to carry out the usual checks on the Vehicle (water level, engine oil level over 1000 km, tyre pressure, etc.), in accordance with reasonable usage.
In this respect, the Hirer must comply with any warning lights on the Vehicle's dashboard and take the necessary precautionary measures where appropriate (including emergency stop).
When parked, the Hirer undertakes to lock the Vehicle, lock the anti-theft device if fitted, and place your personal belongings in the storage compartments or boot, and to draw all curtains which reduce visibility from the outside into the Vehicle.
The Vehicles are equipped with high visibility waistcoat(s) (placed in the passenger compartment) and a warning triangle (placed in the boot or under the seat). This safety kit (triangle + waistcoat(s)) is made available to you during the rental period. In the event that this kit (triangle + waistcoat(s)) is not returned to you when the Vehicle is returned, Run A Van will charge you a fixed penalty (€50 including VAT).
The non-return of the fire extinguisher will be charged 40€ TTC and that of the first aid kit will be charged 20€ TTC.
CONTRAVENTIONS
Under the Highway Code, the Hirer, as the hirer of the Vehicle, is civilly and financially liable for non-compliance with the Highway Code, and must pay any fines imposed in this respect within the required timeframe in connection with the hire.
In the event of an offence not immediately detected by a law enforcement officer, the Hirer must inform Run A Van of the future postal receipt of this offence during the rental period.
This will be processed by Run A Van and charged at €15 including VAT.
BREAKDOWNS, ACCIDENTS AND THEFT
In the event of a malfunction, breakdown of the Vehicle or an accident requiring immediate or urgent repairs: THE HIRER MUST NOT MAKE ANY REPAIRS (including tyres) without first contacting Run A Van on the assistance numbers indicated on the rental contract.
In the event of an accident or damage to the Vehicle with or without an identified third party, the Hirer must inform Run A Van within 24 hours of becoming aware of the accident or damage and submit to the Run A Van agency, within 5 working days of becoming aware of the accident or damage, a joint report duly completed and signed by the Hirer and the third party concerned, if any.
In the event of a third party absconding, the Hirer must note the number plate of the vehicle concerned and ensure that the contact details of any witnesses are collected. In the absence of this information, the Hirer will be considered responsible and will have to pay the costs of repairing the vehicle and/or the insurance excess, if applicable.
In the event of a dispute with third parties, the Tenant must call the Police or the Gendarmerie so that they can establish the facts and help him/her to fill in the report.
In the event of theft (theft of the vehicle or theft with break-in), the hirer must inform Run A Van and call the Gendarmerie or the Police immediately.
In the event of an accident or damage with or without an identified third party, and whether or not the Hirer is responsible, it is compulsory for the Hirer to submit a completed and signed joint report. Failing this, and except in the case of force majeure making it impossible to submit a report within this time limit, the insurance policies are inapplicable, and Run A Van will invoice the Hirer for all damage attributable to him/her (in particular that suffered by the Vehicle up to the market value of the Vehicle plus the costs and expenses associated with its immobilisation and repair).
TYRE DAMAGE AND PUNCTURES
During the rental period, the vehicle is under the responsibility of the Hirer. The Hirer is therefore responsible for any event occurring to the tyres.
If, upon return of the vehicle, damage is observed and requires the replacement of a tyre, Run A Van will invoice the Hirer for the cost of its replacement, after deduction of its wear and tear if this is less than 20% compared to a new tyre.
If the wear is greater than 20%, Run A Van shall be obliged to replace the pair of tyres concerned and shall invoice the cost of this repair to the Hirer, after deduction of the wear noted by the service provider.
In the event of a puncture, the Hirer can use the vehicle's original equipment to replace the punctured tyre with the spare wheel. This intervention is not part of the Run A Van assistance. The repair of the punctured tyre is the responsibility of the Hirer, who must carry out the repair himself as soon as possible in a garage. Under no circumstances should the Hirer continue to drive without a spare wheel. In the event of a puncture that has caused too much damage to the tyre to allow it to be repaired (e.g. impact on the sidewall or explosion of the tyre), the Hirer must inform Run A Van immediately and go to the agency to obtain a new spare tyre. This replacement will be invoiced to the Hirer under the conditions explained in the previous paragraph.
DAMAGE TO THE VEHICLE OR TO A THIRD PARTY
In the event of an accident or damage to the rented Vehicle without an identified third party, the Hirer must inform Run A Van within 24 hours of becoming aware of it. If insurance is applicable, Run A Van will invoice the Hirer for the amount of the insurance excess of €1236 including tax for damage covered by insurance, plus the costs and expenses related to the immobilisation and repair of the vehicle (sun protection film, adhesive advertising, paint, Run A Van staff time, accessories, etc.), as well as a flat-rate indemnity (€50 including tax) for the cost of administrative processing borne by Run A Van, within the limit of the amount of the deposit stipulated on the contract.
N.B.: Damage to the vehicle caused by the hirer during the presentation of the vehicle is attributable to the hirer even if the contract or the initial inventory of fixtures has not yet been established.
The hirer is responsible for his/her children before, during and after the rental period. Run A Van accepts no responsibility for any damage or injury to minors during their stay at the agency.
Under no circumstances should the Hirer abandon the rented vehicle after an accident or breakdown. The Hirer must keep the vehicle under his/her responsibility until Run A Van's assistance can intervene.
In the event of theft of the Vehicle: the Hirer must, within 24 hours of becoming aware of the theft, report it to the relevant authorities and provide Run A Van with the report of the theft, the keys and any anti-theft system of the Vehicle.
If the keys are stolen with the Vehicle, the Hirer must ensure that this is reported to the relevant authorities and included in the complaint.
Failing this, and except in the case of force majeure making it impossible to hand over the report of the complaint and the keys of the Vehicle within this period, the insurance policies are inapplicable, and Run A Van will invoice the Hirer for all the damage attributable to it (in particular that suffered by the Vehicle up to the market value of the Vehicle plus the costs and expenses linked to its immobilisation and repair)
Damage caused by the hirer may concern the whole vehicle, inside and outside. The cost of repairing the damage will be communicated to the hirer after a replacement or repair estimate has been drawn up.
COSTS RELATED TO THE IMMOBILISATION AND RESTORATION OF THE VEHICLE
In the event of an accident or in the event of improper use of the vehicle, its equipment or components, the damage will be estimated on the basis of an estimate from a professional and/or by Run A Van.
In the event of major damage and/or in the event of disagreement with the Hirer, Run A Van or the Insurer may request the intervention of a car expert to draw up an expert report detailing the nature and cost of repairs. The costs of the expert report shall be borne entirely by the Tenant.
The costs and expenses associated with the immobilisation and restoration of the Vehicle may include:
- The cost of towing the Vehicle and possibly the cost of delivering a replacement vehicle,
- Costs established by mechanical and/or bodywork professionals,
- the cost of purchasing and delivering parts, equipment, accessories, whether or not separable, both inside and outside the Vehicle, solar film, adhesive advertising,
- the invoicing of the time spent by Run A Van for the repair and/or refurbishment or replacement of parts, equipment, accessories, whether or not separable, both inside and outside the Vehicle, at the rate of €50 per hour per person, including VAT,
- the invoicing of travel expenses necessary to carry out estimates, work, repairs and/or the restoration of the Vehicle and/or its equipment and accessories, whether or not they can be separated (€0.45 incl. tax/km),
- the cost of immobilisation of the Vehicle, beyond the rental period of this contract, at the rate of €50 (inclusive of tax) per day that the Vehicle is immobilised, until it has been repaired to a sufficient standard to enable the Vehicle to be rented again.
The costs and expenses covered by the insurance and included in the all-risk insurance excess of €1236 including VAT will be clearly established by the insurer. All other additional costs will either be covered and limited to the amount of the security deposit, up to the amount of their real costs, or charged extra if their amounts are higher than the security deposit and the Tenant has not complied with these T&C.
In the event of breakdowns, accidents or damage caused by one or more abnormal uses of the Vehicle, insurance is not applicable. In this case, you are responsible for all damage attributable to you (including damage to the Vehicle up to the market value of the Vehicle plus the costs of immobilisation).
REPLACEMENT VEHICLE
When the Vehicle is reserved, Run A Van informs the Renter that in the event of an event beyond its control affecting the reserved Vehicle and rendering it completely unusable (accident, theft, unavailability of new parts, etc.), Run A Van shall be obliged to offer the Renter another vehicle. Depending on Run A Van's availability, the vehicle may be of an identical, higher or lower category. Only in the event that the vehicle category is lower, Run A Van will apply the price of the vehicle actually hired, without any further compensation.
If several events of this type occur simultaneously on several of our vehicles, as the Run A Van fleet is not expandable, we shall be obliged to cancel the booking and the Hirer shall be reimbursed the full amount of the deposit paid, without any additional compensation. Run A Van may however assist the Hirer in finding alternative solutions with local service providers.
In the event of breakdowns, accidents or damage caused by one or more abnormal uses of the Vehicle, or directly involving the responsibility of the Hirer, Run A Van reserves the right to offer the Hirer another vehicle or not.
In this case, and if the Renter chooses to hire a replacement vehicle, Run A Van will make him/her fill in and sign a new rental contract specific to the rental of the replacement vehicle. This new contract will be invoiced at the current rate and a new deposit will be paid.
STATE OF CLEANLINESS ON RETURN OF THE VEHICLE
The vehicle must be returned in the same condition in which it was received.
This implies that the tenant must :
- Vacuum the interior of the vehicle, including the storage compartments
- brush the floor if there is mud
- clean the refrigerator, dishes and cooking system with household products.
- refueling
- clean the exterior of the vehicle by running it through a car wash roller at a service station.
PLACE AND METHOD OF RETURN
All Vehicle returns must be made only at the Run A Van reception site at 63 rue Général Lambert in St Leu, within the company premises, and under the conditions stipulated in the rental contract. The maximum time for returning the Vehicles is 6 p.m.
In certain special cases, in particular in relation to flight schedules, and only after acceptance by Run A Van, the rented Vehicle may be returned after this time.
The vehicles will be returned blind, i.e. at the agency but without the presence of Run A Van staff.
The vehicle must be dropped off at the agreed time in the agency's premises and the key left in the place provided for this purpose, whatever the day of the week, Sundays and public holidays included.
A vehicle return procedure is provided to the Hirer by email prior to hire and is available in the vehicle. Once the vehicle has been dropped off at the agency and the keys have been left in the designated area, the hirer must inform Run A Van by SMS, which ends the hirer's responsibility for the vehicle.
Without SMS, the vehicle remains the responsibility of the Hirer and any damage, fire or theft that may occur to the Vehicle between its abandonment and its recovery by Run A Van will be fully charged to the Hirer.
In the event of blind return to a location other than Run A Van's premises, the Vehicle will be considered abandoned and any damage, fire or theft that may occur to the Vehicle between its abandonment and its recovery by Run A Van will be fully charged to the Hirer.
RENTAL EXTENSION OR EARLY RETURN
Any extension of the rental period requested by the Hirer must be specifically requested by telephone or email and confirmed in writing by text message or email by Run A Van. The rate applied per additional day corresponds to the daily rate based on the fixed price of 4 days' rental for the category of vehicle concerned.
Any early return of the rented vehicle does not entitle Run A Van to reimbursement of the unused days initially included in the contract.
SCHEDULE
The Hirer must return the Vehicle, its keys and papers to Run A Van at the date and time agreed in the Rental Agreement, i.e. 6pm maximum.
The Hirer must inform Run A Van, as soon as possible, of any event preventing him/her from returning the Vehicle at the agreed date and time, under penalty of constituting a misappropriation liable to legal proceedings.
If the Hirer wishes to extend the rental period, he/she must inform Run A Van as soon as possible. The Rental Agreement must be amended accordingly before the end of the initial rental period.
In all cases, the Hirer shall be liable for the hire charge and any costs relating to damage to the Vehicle until the Vehicle is returned to Run A Van.
The Vehicle is deemed to have been returned when the Hirer deposits the Vehicle's keys at the location indicated with SMS as proof. As long as no SMS has been sent, the Hirer retains responsibility and is liable for the rental amount and any damage attributable to him/her (including damage to the Vehicle) until the keys are actually handed back.
Run A Van cannot be held responsible for any goods that the Hirer may leave in the Vehicle at the end of the Rental Agreement.
FUEL
Run A Van provides the Hirer with a fully fuelled Vehicle. The Vehicle must therefore be returned with a full tank of fuel.
In the event that the Vehicle is returned without having been refuelled, Run A Van will charge the Hirer a fixed fee of €150.
CONTROL OF THE CONDITION OF THE VEHICLE
Run A Van staff will carry out an inventory of the Vehicle on the day after the return date (within 72 hours).
As rental returns are made blind, the Renter entrusts the inspection of the Vehicle to Run A Van's staff and accepts de facto any findings. Run A Van invites the Hirer to carry out an inventory of fixtures on leaving by photographing the Vehicle once it has been parked in the agency's premises.
If the Hirer wishes to check the apparent condition of the Vehicle with a member of the Hirer's staff on return from the rental and compare it to the condition stated in the Rental Agreement, the Hirer must return the Vehicle within the opening hours of the agency, i.e. between 9.00am and 12.00pm from Monday to Friday. For returns on Sundays and public holidays, no contradictory inventory of fixtures is possible.
If the apparent condition of the Vehicle on return differs from that on departure, as evidenced by the video of the inventory of fixtures on departure, Run A Van will invoice the Hirer for the damage noted, plus the costs and expenses associated with its immobilisation and repair.
If the Hirer chooses not to carry out this contradictory inspection with Run A Van on the return of the Vehicle, he/she entrusts Run A Van with the task of carrying it out alone and accepts the findings thus made and the invoicing of the corresponding damage, plus the costs and expenses related to the immobilisation and repair of the Vehicle, if applicable.
In all cases, in the event of damage to the Vehicle, Run A Van will invoice the Hirer a fixed fee (€50 including VAT) for the cost of administrative processing borne by Run A Van.
DATA PROTECTION / PRIVACY POLICY
As a data controller, we may use your personal information and that of any additional drivers collected in connection with the contract or any related contract or service (the Customer Personal Data) and disclose it for the purposes set out in this paragraph in accordance with applicable data protection laws and our privacy policy which can be found below.
We, Run A Van, can :
- To use customer personal data for the management of the rental, our commercial relationship and our loyalty programme, to communicate with you or to assist you in your rental. We use customer personal data for these purposes because of contractual necessity or because of our legitimate interests in providing the requested services in accordance with the personal data protection rights of you and any additional drivers.
- Retain customer personal data relating to an incident in your or an additional driver's transactions with us if we believe that as a result of that incident you or the additional driver may pose a risk to future rentals. For example, data on non-payment, theft or damage to the vehicle, inappropriate behaviour with staff or any driving under the influence of alcohol or drugs. This data could prohibit the holder of the name with which it is associated from renting another vehicle in the future.
- To use customer personal data to conduct telephone or email satisfaction surveys. We use customer personal data for these purposes on the basis of our legitimate interests in ensuring customer satisfaction with the services we offer in accordance with the personal data protection rights of you and any additional drivers
- To send you marketing communications (via email or social networks) about similar products, promotions or competitions that we think may be of interest to you in accordance with the privacy rights of you and any additional drivers.
- to carry out statistics and analysis of the use of our products and services by you or any additional drivers, including anonymised statistics which will enable us to provide better services to customers in the future.
